INDIAN DEMOCRACY’S BIGGEST PROBLEM IS THAT IT DOES NOT TRUST ONE OF THE IMPORTANT PERIPHERALS OF THE DEMOCRACY , IT IS THE POLICE THE COUNTRY’S MOST IMPORTANT SECTION OF THE SOCIETY THAT IS THE RICH AND INFLUENTIAL PEOPLE DO NOT BELIEVE IN THE POOR PEOPLE , THE LOWER INCOME GROUPS AND THE PENIROUS CLASS OF THE SOCIETY ARE MOST AFFECTED BY THE POLICE , THE BIGGEST ISSUES WITH INDIAN POLICE IS THE  STRUCTURE AND THE WAY IT PERFORMS THE DUTY 

POLICE PERSONNEL IN INDIA OFTEN POLICE FACULTY IN INDIA GENERALLY BUY INTO TWO SORTS OF INFRINGEMENT. THE FIRST IS DEFILEMENT AGAINST PEOPLE OR ESTABLISHMENTS WHICH GENERALLY FOCUSES ON THE PAY OR VOCATION OF THE PERSON IN QUESTION. TRAFFIC POLICE BLACKMAIL CASH FROM DRIVERS CONSISTENTLY. INDEED, EVEN PEDDLERS, ROAD SELLERS AND HUMBLE RETAILERS KNOW ABOUT THE REQUESTS FROM THE NEIGHBORHOOD POLICE HEADQUARTERS. THEY ARE COMPELLED TO PAY WEEK BY WEEK INSTALLMENTS (HAFTAS) OR ENDURE BLACKMAIL BECAUSE OF COPS AT SUCCESSIVE SPANS BASICALLY TO WORK THEIR BUSINESS. ENROLLMENT OF CASES, AS WELL, REQUIRES A PAY OFF TO THE POLICE HEADQUARTERS IN CONTROL. ALL CUSTODIAL PASSINGS ARE TO A GREAT EXTENT THOSE OF POOR OR LOWER CLASS INDIVIDUALS. AS INDICATED BY A COMMON ORGANIC PRODUCT MERCHANT IN VARANASI, THE POLICE, PRODDED BY NUMEROUS IRRELEVANT MISLEADING ALLEGATIONS, TORMENTED HIM IN A FRIGHTFUL WAY "MY OPTIONS AND LEGS WERE LIMITED; A WOODEN STICK WAS GONE THROUGH MY LEGS. THEY BEGAN BEATING ME GRAVELY ON THE LEGS WITH LATHIS (TWIRLY DOOS) AND KICKING ME. THEY WERE SAYING, 'YOU SHOULD NAME EVERY ONE OF THE INDIVIDUALS FROM THE 13-MAN GROUP.' THEY BEAT ME UNTIL I WAS CRYING AND YELLING FOR HELP. WHENEVER I WAS NEARLY SWOONING, THEY HALTED THE BEATING. A CONSTABLE SAID, 'WITH THIS SORT OF A BEATING, AN APPARITION WOULD FLEE. IS THERE ANY GOOD REASON WHY YOU WON'T LET ME KNOW WHAT I NEED TO KNOW?' THEN THEY FLIPPED AROUND ME… THEY POURED WATER FROM A PLASTIC CONTAINER INTO MY MOUTH AND NOSE, AND I SWOONED RAVI NAIR, THE ONE WHO HEADS THE SOUTH ASIA HUMAN RIGHTS DOCUMENTATION CENTER SAID IN A QUESTION AND ANSWER SESSION THAT NDIA HAS THE LARGEST NUMBER OF POLICE TORMENT AND CUSTODIAL PASSINGS AMONG THE WORLD'S MAJORITY RULE GOVERNMENTS AND THE MOST VULNERABLE REGULATION AGAINST TORMENT. THE POLICE REGULARLY WORK IN AN ENVIRONMENT OF EXEMPTION, WHERE TORMENT IS VIEWED AS NORMAL POLICE CONDUCT TO SEPARATE ADMISSIONS FROM LITTLE PICKPOCKETS TO POLITICAL SSUSPECT IN THE RESULT OF THE EMERGENCY, A PERIOD WHICH SAW INCREDIBLE MONSTROSITIES SUBMITTED UPON THE POPULACE BY THE POLICE, THERE WAS A SHOUT AGAINST THE POLICE AND REQUESTS FOR DESTROYING THE CENTRAL POLICE ORGANIZATIONS. THE GOVERNMENT OF INDIA DELEGATED A NATIONAL POLICE COMMISSION ON FIFTEENTH NOVEMBER, 1977. THE COMMISSION WAS DELEGATED FOR NEW ASSESSMENT OF THE JOB AND EXECUTION OF THE POLICE BOTH AS A REGULATION UPHOLDING OFFICE AND AS AN ORGANIZATION TO SAFEGUARD THE FREEDOMS OF THE RESIDENTS REVERED IN THE CONSTITUTION. IT EMERGED WITH THREE REPORTS. THE NATIONAL POLICE COMMISSION PRESENTED THEIR 8 VOLUME REPORT SOMEWHERE IN THE RANGE OF 1979 AND 1981 WHICH CONTAINED SUGGESTIONS TO RE-COORDINATE THE POLICE AND GIVE THEM ANOTHER FACE, A RECENT FAD OF WORKING, PRACTICAL AUTONOMY, SEVERE RESPONSIBILITY AND INCREDIBLE SKILL. IN THEIR SUBSEQUENT REPORT SUBMITTED IN AUGUST, 1979, THE COMMISSION IN CHAPTER XV MANAGED "IMPEDANCE WITH AND ABUSE OF POLICE BY ILLEGAL OR IMPROPER ORDERS OR PRESSURE FROM POLITICAL EXECUTIVE OR OTHER EXTRANEOUS SOURCES - REMEDIAL MEASURES". ASIDE FROM THE ARRANGEMENT OF POLICE RELATIONSHIP BECAUSE OF A CROSS COUNTRY POLICE FOMENTATION WHICH, AS SECURED, HAVE TODAY CRUMBLED TO BEING SUPPORT ASSOCIATIONS OF DIFFERENT IDEOLOGICAL GROUPS, NOT ONE SUGGESTION WAS CARRIED OUT. THE THIRD REPORT OF THE NATIONAL POLICE COMMISSION, ALLUDING TO THE NATURE OF CAPTURE BY THE POLICE IN INDIA REFERENCED THAT .FORCE OF CAPTURE WAS ONE OF THE MAIN WELLSPRINGS OF DEFILEMENT IN THE POLICE. THE REPORT PROPOSED THAT OVERALL ALMOST 60% OF THE CAPTURES WERE EITHER SUPERFLUOUS OR INAPPROPRIATE AND THAT SUCH OUTLANDISH POLICE ACTIVITY REPRESENTED 43.2% OF THE USE OF THE JAIL OFFICE


CONCLUSION 

INDIAN POLICE HAS TO MAKE CHANGES IN IT’S WORKING WHICH WILL HELP THE PEOPLE TO FOCUS AND RESPECT THE POLICE , OTHERVISE THE FUNCTIONING OF DEMOCRACY WILL BE LAGGARD AS PEOPLE IF CAN NOT TRUST POLICE IT WILL LOWER THE CHANCES OF GETTING CLOSER TO JUSTICE SYSTEM WHICH IS A PROBLEM THAT NEEDS TO BE ADDRESSED AS SOON AS POSSIBLE AND THE WORKING IF GETS BETTER IT WILL HELP IN THE FUNCTIONING OF DEMOCRACY .

TOLLEY Vs, J.S FRY & SONS LTD – (1931) Facts The defendants were owners of chocolate manufacturing company. They advertised their products with a caricature of the claimant, who was a prominent amateur golfer, showing him with the defendants’ chocolate in his pocket while playing golf. The advertisement compared the excellence of the chocolate to the excellence of the claimant’s drive. The claimant did not consent to or knew about the advertisement. Issue The claimant alleged that the advertisement suggested that he agreed to his portrait being used for commercial purposes and for financial gain. He further claimed that the use of his image made him look like someone who prostituted his reputation for advertising purposes and was thus unworthy of his status. At trial, several golfers gave evidence to the effect that if an amateur sold himself for advertisement, he no longer maintained his amateur status and might be asked to resign from his respective club. Furthermore, there was evidence that the possible adverse effects of the caricature on the claimant’s reputation were brought to the defendants’ attention. The trial judge found that the caricature could have a defamatory meaning. The jury then found in favor of the claimant. Held The House of Lords held that in the circumstances of this case – as explained by the facts – the caricature was capable of constituting defamation. In other words, the publication could have the meaning alleged by the claimant. The Lords also ordered a new trial limited to the assessment of damages. NEWSTEAD V LANDON EXPRESS NEWSPAPER LTD, (1939) Facts: A newspaper published a defamatory article about Harold Newstead. However, another person with this name brought an action in libel. He claimed that the article had been misunderstood as leading to him. The defendant newspaper recognised that they published the article. Also, they denied that they had the intention of being defamatory of him. Consequently, the claimant argued that the newspaper was under a duty. The duty was to give a clear and complete description of the correct person. Moreover, the claimant argued that the defendants were in breach of the duty. Issues: The issue in Newstead v London Express Newspaper, was if the reasonable persons would have understood the words complained of to refer to the plaintiff. Held: The Court of Appeal stated that in accordance with the current law on libel, liability for libel does not depend on the intention of the defamer; but on the fact of the defamation. Accordingly, a reasonable man, in this case a newspaper publisher, must be aware of the possibility of individuals with the same name and must assume that the words published will be read by a reasonable man with reasonable care.

Rules as to delivery of goods

                             Rules as to delivery of goods Section 2(2) of Sale of Goods Act defines ‘delivery’ as a ‘voluntary transfer of possession from one person to another.’ Thus, if the transfer of goods is not voluntary and is taken by theft, by fraud, or by force, then there is no ‘delivery. Moreover, the ‘delivery’ should have the effect of putting the goods in possession of the buyer. The essence of the delivery is a voluntary transfer of possession of goods from one person to another. There is no delivery of goods where they are obtained at pistol point or theft. 1.
