                    EPIDEMIC DISEASES ACT 1897 



INTODUCTION 

THE EPIDEMIC DISEASES ACT 1897 WAS PROMUILGATED IN THE YEAR 1897 BY THE BRITISH COLONIAL GOVERNMENT , THIS BILL WAS INTRODUCED TO HANDLE THE EPIDEMIC OF BUBONIC PLAGUE WHICH IS INFAMOUS FOR THE DEATHS OF MILLIONS OF PEOPLE ACROSS THE WORLD , THE SAME EPIDEMIC WAS CREATING PROBLEMS IN THE BOMPAY PRESIDENCY IN THE YEAR 1890’S WHICH WWAS GETTING OUT OF HAND AND WAS ON THE VERGE OF TRANFORMING INTO A CATASTROPHE IN THE INDIAN HISTORY . THE GOVEREMT WAS KEEN TO USING THE POWERS CONFERRED BY THE ACT WHICCH WOULD PROVE BENEFIAL IN SEARCHING THOSE INHABITANTS WHO ARE SUFFERING WITH THE PROBLEMS OF THE EPIDEMIC AND CAN FURTHER DESTROY THE INFECTED AREAS AS TO PROTECT THE HUMANITY . 


PROVISIONS OF THE ACT 

THE ACT IS CONCERNED FOR THE BETTERMENT AND PREVENTION OF SPREADING OF THE EPIDEMIC AND TO PREVENT THE WIDESPREAD DISEASE INFECTION . 

SECTION 2 OF THE STATUTE PROVIDES FOR THE POWER TO TAKE SPECIAL MEASURES AND PRESCRIBE REGULATIONS REGARDING THE EPIDEMIC DISEASE . WHENEVER THE STATE GOVERNMENT IS SATISFIED THAT THE STATE OR ANY PART OF THE TERRITORY HAS BEEN INFECTED WITH THE OUTBREAK OF DISEASE AND WHICH CAN LEAD TO THE THREAT POF LIFE AND EXISTENCE TO A LARGE GROUP OF PERSONS , THE STATE SHALL TAKE UP CERTAIN MEASURES WHICH WILL ENHANCE THE CHANCES OF CURBING THESE DISEASES AND RELATED PROBLEMS , IF THE STATE GOVERNMENT DURING THE TIME IS INSUFFICIENT OF THE POWER THEN IT CAN BY NEW LAWS AND PROVISIONS SHALL WORK FOR THE PREVENTION OF SPREADING THE DISEASE TESTS OF PEOPLE TRAVELING BY RAIL OR OTHER MEANS, AND ISOLATION, HOSPITALIZATION, TEMPORARY ACCOMMODATION OR OTHERWISE, OF PERSONS SUSPECTED TO BE PROBATION OFFICERS INFECTED WITH ANY SUCH DISEASE. 

SECTION 3 PROVIDES FOR PENALTIES FOR NON-COMPLIANCE WITH ANY REGULATION OR INSTRUCTION MADE UNDER THE ACT. THIS IS IN ACCORDANCE WITH SECTION 188 OF THE INDIAN PENAL CODE.

SECTION 4 PROVIDES LEGAL PROTECTION FOR EMPLOYEES WORKING UNDER THE ACT.PREVIOUS LAUNCH. IN 2018, THE VADODARA DISTRICT COLLECTOR OF GUJARAT ISSUED A NOTICE UNDER THE LAW DECLARING THE KHEDKARMSIYA DISTRICT IN WAGHODIA TO BE DECLARED CHOLERA-INFECTED AFTER 31 PEOPLE COMPLAINED OF SYMPTOMS OF THE DISEASE.

IN 2015, TO DEAL WITH MALARIA AND DENGUE IN CHANDIGARH, THE ACT WAS ENACTED AND REGULATORY AUTHORITIES WERE INSTRUCTED TO ENSURE THE ISSUANCE OF NOTICES AND CHALLANS OF RS 500 OFFENDERS. IN 2009, TO DEAL WITH THE OUTBREAK OF SWINE FLU IN PUNE, THE POWER OF PHASE 2. WAS USED TO OPEN TESTING CENTERS IN PUBLIC HOSPITALS THROUGHOUT THE CITY, AND SWINE FLU WAS SAID TO BE A CONTAGIOUS DISEASE.

CONCLUSION 

IT IS AN IMPORTANT LAW WHEN IT COMES TO CURBING THE COBTAGIOUS AND DISEASES WHICH HAVE A STATURE OF INFECTING A LARGE NUMBER OF PEOPLE WITH INCREASING DEATH RATES   IT IS IMPORTANT FOR US TO UNDERSTAND THE HISTORY AND COURSE OF ACTIONS THAT WERE TAKEN IN ORDER TO PREVENT SUCH SITUATIONS FROM OCCURING IN THE NEAR FUTURE . THE LAW WAS WAY AHEAD FROM IT’S TIME AND PROVIDED FOR PROVISIONS WHICH IF IMPLEMENTED WILL CREATE A FRUITFUL RESULTS ALONGWITH THE PROTECTION OF LIFE OF INHABITANTS ROM FALLING IN DANGER .THE GOVERNMENT OF INDIA HAS STILL USED THIS LAW TO GET OUT OF THE DANGERS THAT HAVE COME FROM TIME TO TIME TO TACKLE THE SCENARIOS.
