INDIAN GAMBLING LAWS 




Introduction 


Because of the country's deteriorating pandemic conditions, many Indians have become addicted to gambling games. They have begun to anticipate gambling prize money in order to meet their social and financial needs. Money laundering and black money sources in India have increased as a result of such practises.


Part II of the State list includes betting and gambling. They are detailed in the seventh schedule of the Indian Constitution. In other words, the state government has complete control over betting and gambling practises in their state. They can also enact state-specific legislation. A good example of this is the decision made by the majority of states to adopt the Public Gambling Act 1976 . 


To differentiate the games, India divides them into two broad categories. There are two types of games: games of chance and games of skill.


Game of chance: A game of chance is any game that is played at random. These games are entirely based on chance. These games can be played without any prior knowledge or understanding. For example, dice games, number selection, and so on. In India, such games are considered illegal.

Game of skill: A game of skill is any game that is played based on the player's prior knowledge or experience with the game. Analytical decision-making, logical thinking, capability, and other skills will be required. Some games may also necessitate some preliminary training in order to be successful. Most Indian states consider such games to be legal.


If a gambling game necessitates a certain level of skill, it may not be considered illegal at all. However, there is a lot of bias surrounding such gambling games.


What is the current legal status of gambling in India?


In India, horse racing and lotteries are legal. Horse racing requires some prior knowledge, so it isn't just about gambling.

Lotteries have been legalised in several Indian states.Goa, Kerala, Arunachal Pradesh, Assam, Maharashtra, Madhya Pradesh, Mizoram, Manipur, Meghalaya, Punjab, Nagaland, West Bengal, and Sikkim are among these states.

Under the Public Gambling Act of 1976, online gambling and land-based casinos are legal in Goa, Sikkim, Nagaland, and Daman.

The Bombay Prevention of Gambling Act, 1887, prohibits gambling and declares it illegal in Maharashtra.

E-gaming (lottery games) is now legal in Sikkim and Nagaland.

According to the andhrapradesh State Gaming Act of 1974, skill games are illegal in Telangana and Arunachal Pradesh.

The All India Gaming Federation, The Rummy Federation, and The Federation of Indian Fantasy Sports have all adopted a self-regulation code for all of their advertising.

The legal status of gambling in India in 2021 requires reassured and revalued . gambling laws that are more uniform. The government needs to step up its game by installing a proper legal framework on the subject. as india is in dire need for such laws .as it is clear theugh the surveys that indian youth is involved in gambling keeping those aspects in account the government should take up rules and regulations which solve this problem .
