Insolvency and bankruptcy proceedings involve significant financial and legal consequences for companies, creditors and other stakeholders. The Insolvency and Bankruptcy Code, 2016 (IBC) provides a structured framework for resolution of insolvency, subject to its statutory requirements and applicable judicial interpretation.

Key aspects of insolvency proceedings

1. Identify the nature of the debt
The relationship between the parties and the character of the debt—such as financial or operational debt—can be important in determining the applicable insolvency mechanism.

2. Examine default
Documentary evidence concerning the debt, invoices, agreements, payment records, acknowledgements and the occurrence of default may become critical.

3. Understand the statutory process
IBC proceedings involve specific requirements concerning applications, notices, admission, moratorium, resolution processes and other stages prescribed by law.

4. Maintain documentary records
Contracts, financial statements, invoices, bank records, correspondence and other relevant documents should be preserved systematically.

5. Understand stakeholder rights
Creditors, corporate debtors, resolution professionals and other stakeholders may have different statutory roles, rights and obligations during the insolvency process.

6. Examine available remedies
Depending upon the stage and circumstances, legal remedies may include statutory applications, responses, appeals or proceedings before the appropriate adjudicatory forum.

7. Timing matters
Insolvency law operates within a structured procedural framework. Delayed action or incomplete documentation can create avoidable complications.

IBC litigation is a useful reminder that financial disputes are not solved by numbers alone. The debt, default, documents and statutory procedure must all fit together.

And in insolvency proceedings, “I’ll send the documents tomorrow” is rarely a strategy worth building an entire case around.
